2.It is submitted that the case of the prosecution is that the defacto complainant lodged a complaint before the respondent police alleging that the petitioner received a sum of Rs.1 Lakh from the defacto complainant and failed to repay the amount and cheated her. 3.The learned Government Advocate (Crl.side) submitted that there is no case or any petition enquiry is pending against the petitioner.
