O R D E R

This writ petition has been filed for a Mandamus seeking for a direction to the first respondent grant an exemption to the petitioner to be appointed in the post of Noon Meal Organizer in the Shanmuga Vilas Kalasalai Primary School, Nachandupatti, Thirumayam Taluk, Pudukottai District, as per the letter forwarded by the third respondent vide its Na.Ka.V5/027/2021, dated 13.12.2021 and consider based on the petitioner's representation dated 12.02.2022. 2/6

The learned counsel for the petitioner submitted that the petitioner's mother Chitra was working as Noon Meal Worker in Shanmuga Vilas Kalasalai Primary School, Nachandupatti, Thirumayam Taluk, Pudukottai District. She died, while in service on 22.09.2020 due to ill-health. The petitioner and his brother Suthirkumar are the only legal heirs of his deceased mother. His brother has given consent for his appointment on compassionate grounds on the death of his mother. He studied upto 10th standard and completed ITI Mechanic (Motor Vehicle) in Advanced Industrial Training Centre, Rajagopalapuram, Pudukkottai District. He gave a representation to the second respondent to appoint him to the post of Noon Meal Organizer in Shanmuga Vilas Kalasalai Primary School, Nachandupatti, Thirumayam Taluk, Pudukottai District.

His representation was forwarded by the third respondent vide letter in Na.Ka.V5/027/2021, dated 13.12.2021 to the first respondent and since there was no action taken, he submitted another representation, dated 12.02.2022 to the first respondent. Even thereafter, no step was taken. Therefore, this writ petition has been filed.

3. Mr.A.Sivanu Pandian, learned Government Advocate takes notice on behalf of the respondents submitted that the position now is that only female is being appointed for the post of Noon Meal Organizer.

4.The proposal of the Personal Assistant of District Collector, Pudukottai District to the Director of Social Welfare and Women Rights Department, Chennai in Na.Ka.V.5/027 dated 13.12.2021 shows that a recommendatory proposal for giving relaxation to the petitioner for appointing him in the place of his mother on compassionate grounds was sent.

Considering this and also the fact that no order was passed by the first respondent on the proposal sent by the third respondent, this Court directs the first respondent to consider the proposal letter in Na.Ka.V.5/027, dated 13.12.2021 and petitioner's representation, dated 12.02.2022, and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. 4/6

6. With the above direction, this writ petition is disposed of. No costs.
