Respondents/Respondents Prayer in WMP(MD) No.10147 of 2022 :- This Writ Miscellaneous Petition filed under Article 226 of the constitution of India, to extend the time granted in order dated 18.05.2022 passed in WP(MD) No. 10185 of 2022 on the file of this Honble Court by a further period of 6 weeks to comply with the 1/3
directions issued in the above order .
Prayer in WP(MD) No.10185 of 2022:- This Writ Petition filed under under Article 226 of the constitution of India, , praying this court to issue a Writ of Mandamus directing the 1st Respondent to accept the payment of Rs.21.50 towards payment of the 1st installment of the conditional order passed by the 6th Respondent in S.A.No.223 of 2022 dated 25.03.2022 and to grant further 8 weeks extension of time for payment of the 2nd installment amount .
ORDER:- This Writ Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.Kannan Advocate for the Petitioner and this Court made the following order:
[Order of the Court was made by S.S.SUNDAR, J.] This petition is filed to extend the time granted by this Court on 18.05.2022 in W.P(MD)No.10185 of 2022.
2.Heard Mr.Kannan, learned counsel appearing for the petitioner.
3.Considering the fact that the petitioner is not a borrower but only a guarantor, who is interested in secured property and considering the reasons stated in the affidavit filed in support of this petition, time for paying a sum of Rs.25 lakhs, is extended for a further period of six weeks from today. In case, the petitioner fails to comply with the direction, the respondent Bank is at liberty to proceed further, ignoring the order passed extending the time.
4.Accordingly, this petition is ordered.
