To call for the records pertaining to the order dt.11.11.2022 passed in MC.No.4 of 2022 on the file of the Family Court,Karur and set aside the same .

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SENTHIL M.P, Advocate for the petitioner and of MR.D.R.MURUGESAN, Advocate on behalf of the Respondent, the court made the following order:- The above petition has been filed seeking permission to withdraw the arrears of maintenance amount that was deposited by the respondent in M.C.No.4 of 2022 on the file of the Family Court, Karur in pursuance of the order of this Court dated 03.02.2023.

2. When the matter is taken up for hearing today, the learned counsel appearing for the respondent has raised objections alleging that criminal revision is still pending.

Considering the facts and circumstances of the case and also taking note of the fact that minor daughter is in the custody of her mother, the petitioner is permitted to withdraw the arrears amount available in the credit of M.C.No.4 of 2022. Accordingly, this petition is allowed sd/- 08/06/2023 / TRUE COPY / /06/2023 Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
