PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call 1/5

for the records pertaining to the impugned proceedings No.1273/Aa1/2023 dated 28.12.2023 issued by the 2nd respondent and quash the same on the ground that the same and consequently directing the 3rd respondent to register the pending document No.42 dated 05.09.2022 submitted by the petitioner. ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned proceedings No. 1273/Aa1/2023 dated 28.12.2023 issued by the 2nd respondent and consequently directing the 3rd respondent to register the pending document No.42 dated 05.09.2022 submitted by the petitioner.

2. Through the impugned order, the respondent has refused to register the sale deed since fourth respondent has refused to come before the authorities and execute the sale deed. Admittedly, the fourth respondent is the owner of the property who had agreed to execute the sale deed with the petitioner. After preparing the sale deed, the fourth respondent has refused to 2/5

come before the authorities and complete the formalities. In such circumstances, the petitioner has preferred a complaint before the authority who had considered the same under Section 77 A and refused registration and directed the petitioner to approach appropriate civil Court.

3. After hearing the submissions, this Court is of the considered opinion that when the fourth respondent has refused to complete the formalities, the remedy to the petitioner is before the Civil Court only.

4. Therefore, the impugned order is confirmed and the petitioner is at liberty to approach the appropriate Civil Court.

5. With this observation, this writ petition is dismissed. There shall be no order as to Costs. Consequently, connected miscellaneous petitions are closed.
