Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.BALASUBRAMANIAN N, Advocate for the petitioner and of Mr.B.THANGA ARAVINDH, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed to modify the condition No.5(b) imposed in Crl.O.P.(MD)No.4210 of 2023, dated 10.03.2023, that the petitioner depositing a sum of Rs.1,20,000/- each to the credit of Chairman/District Collector, District Mineral Foundation Trust of the concerned District.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl.Side) appearing for the respondent.

3. Taking into consideration the facts and circumstances of the case and that the petitioner had taken sand from his own patta land and hence the condition No.5 (b) imposed on the petitioner is deleted.
