Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 324 and 506(ii) I.P.C, in Crime No.153 of 2018 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 22.11.2018, the petitioner said to have assaulted the defacto complainant and demanded money for consuming liquor and the petitioner assaulted the brother of the defacto complainant and also threatened them with dire consequences. Hence the complaint.

3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate [Criminal Side] appearing for the respondent.

4. According to the petitioner, he is an innocent and he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case.

5.The learned Government Advocate [Criminal Side] submitted that the victim has sustained simple injury.

6. Considering the facts and circumstances of the case and also considering the fact that the dispute arose on account of drunken state and the injured has sustained simple injury, this Court is inclined to grant Anticipatory Bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Paramakudi and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a likesum to the satisfaction of the learned Judicial Magistrate, Paramakudi concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30.am., until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
