Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a writ of Mandamus,directing the second respondent either to appropriate the Security Deposit available in H.T.SC.No.297 with the sum due from the Petitioner as contemplated under Regulation 5(vi) of the Tamil Nadu Electricity Supply Code or permit the Petitioner to pay the arrears in 10 equal monthly instalments under Regulation 22(4) of the Code 2004 and to restore Electricity Connection.

This Writ Petition has been filed, seeking a direction to the second respondent either to appropriate the Security Deposit available in H.T.SC.No.297 with the sum due from the Petitioner as contemplated under Regulation 5(vi) of the Tamil Nadu Electricity https://hcservices.ecourts.gov.in/hcservices/
Supply Code or permit the Petitioner to pay the arrears in 10 equal monthly instalments under Regulation 22(4) of the Code 2004 and to restore Electricity Connection.
2.Ms.Srimathy,learned Standing Counsel takes notice for the respondents 1 and 2/TNEB. By consent of both parties, the Writ Petition itself is taken up for final disposal at the admission stage itself.
3.When the matter is taken up for hearing today, the learned Senior counsel appearing for the Petitioner agreed to pay the electrical charges as demanded by the respondents in ten equal instalments.
4.In view of the said submission,the Petitioner is directed to pay the electrical charges as demanded by the respondents in 10 equal instalments. The first instalment shall be paid on or before 28.2.2017. On such payment, electricity service connection to the Petitioner company may be restored. The subsequent instalments shall be paid on or before the last working day of every English Calendar month, beginning from March 2017.If the Petitioner fails to pay any one of the instalments as referred to above, it is open to the respondents to disconnect the service connection, without notice to the Petitioner. 5.With the above direction, the Writ Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
