PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to transfer the investigation in Cr.No.40 of 2021 dated 07/02/2021 on the file of the 2nd respondent herein to the 3rd respondent or any other Superior Officer within the District. ORDER

This petition has been filed seeking direction to transfer the investigation in Crime No.40 of 2021 dated 07/02/2021 on the file of the second respondent herein to the third espondent or any other Superior Officer within the District.

2. On the complaint lodged by the petitioner, the second respondent registered First Information Report in Crime No. 40 of 2021 for the offences under Sections 406,420,465,468 and 470 of IPC and in pursuance to the registration of the First Information Report, three accused persons have been arrested and remanded to judicial custody and on the confession statement of the co- accused other two persons have been implicated as an accused and now the second respondent is taking steps to secure the other accused and they are about to complete the investigation. https://hcservices.ecourts.gov.in/hcservices/

3. At this juncture, if the investigation is transferred from the file of the second respondent to the file of the third respondent, the entire investigation done by the second respondent would be affected.

4. In view of the same, the second respondent is directed to complete the investigation and file the final report before the concerned Court within a period of twelve weeks from the date of receipt of a copy of this order. Further the first respondent is directed to monitor the investigation done by the second respondent.
