O R D E R

Heard Mr.Susikumar, learned counsel for the petitioner and Mr.K.S.Selvaganesh, learned Additional Government Pleader appearing for the respondents.

2. The petitioner seeks issuance of writ of mandamus directing the third respondent to register the petitioner's document in respect of his agricultural land situated in Survey No.495/2A of Ariyakulam Village, Naguneri Taluk, Tirunelveli District as agricultural land.

3. he petitioner has already approached this Court by way of earlier writ petitions in WP(MD)Nos.30381 of 2024, 466 of 2025 and 7318 of 2025 and in all these writ petitions, the registering authorities were directed to register the documents, which were presented for registration without refusing on the ground that the lands are housing sites and that the registration is hit by Section 22(A) of the Registration Act. Now the petitioner made a representation to the third respondent on 22.04.2025 in respect of a proposed sale to be effected by the petitioner.

4. The grievance of the petitioner is that the petitioner has been compelled to obtain orders from this Court whenever a portion of the land in the 2/6

very same survey number is sold and the Sub Registrar is now insisting to get court order in respect of proposed sale transaction. Hence, the petitioner is now approaching this Court for issuance of writ of mandamus. The petitioner has clearly stated in the affidavit that the lands are agricultural lands and there is no conversion of agricultural lands into house sites. All these factors have already been discussed in the earlier order passed by this Court in the abovesaid writ petitions. Therefore, there is no impediment to the third respondent to register the petitioner's documents in respect of his agricultural land situated in Survey No.495/2A of Ariyakulam Village, Naguneri Taluk, Tirunelveli District as and when it is presented without refusing registration either on the ground that the said transaction is hit by Section 22(A) of the Registration Act or on the ground that the agricultural lands are being sold as housing sites. It is made clear that the sale deed shall contain an undertaking that the agricultural lands are sold as agricultural lands.

5. With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 08.05.2025 NCC:yes/no Index:yes/no 3/6
