PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to take necessary action upon the complaint of the petitioner dated 12.06.2022 and to protect the petitioner's life and legal right over his property.

O R D E R

The writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the second respondent to take necessary action upon the complaint of the petitioner dated 12.06.2022 and to protect the petitioner's life and legal right over his property. 2.Mr.M.Sakthi Kumar, learned Government Advocate (Criminal Side) takes notice for the respondents 1 and 2. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.The learned counsel appearing for the petitioner submitted that the third respondent is the brother of the petitioner and there is a dispute pending between the petitioner and third respondent with regard to the land at Survey No.44/3A in Vilathikulam town to the extent of 0.31.0 hecter. In this regard, the petitioner gave a complaint before the second respondent Police. Since the second respondent Police has not taken any action, the present Writ Petition has been filed. 2/5

4.The learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2 submitted that based on the complaint given by the petitioner, the second respondent Police has issued C.S.R.No.307 of 2022 and conducted enquiry and closed the same as civil in nature. Again on 12.06.2022, the petitioner gave a complaint and the petition enquiry is pending before the second respondent Police.

5.Recording the same, the second respondent police is hereby directed to consider the petitioner's representation dated 12.06.2022 and conduct enquiry in the matter and take suitable action on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order.

6.With the above direction, this writ petition is disposed of. No costs.
