Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 8(C) r/w 20 (b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.1403 of 2018 on the file of the respondent police, seeks anticipatory bail.

2.It is the case of the prosecution that during a surprise check up the Law Enforcing Officers seized 1.200 Kgs Kanja from the first accused. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution. He would further submit that only based on the confession of the first accused, the petitioner is falsely implicated in this case.

4.The learned Additional Public Prosecutor would submit that the petitioner has three previous cases to his credit. He would further submit that the petitioner sold the contraband to the other accused persons.

5.Considering the facts and circumstances of the case and also considering nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
