ORDER : The Court made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Section 5 and 7(3) of Lotteries Regulation Act, 1998 in Crime No.1795 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on 10.07.2021, during the patrol, the defacto complainant found that the petitioner was indulging in on-line lottery through his mobile phone which was banned in the State of Tamil Nadu and on seeing him, the petitioner left his mobile phone and ran away from the place of occurrence. Hence, the complaint.

3. Today, when the matter is taken up for hearing, the learned counsel for the petitioner seeks permission of this Court to withdraw this petition.

4.At this juncture, the learned Government Advocate (Crl.side) for the respondent submits that the petitioner is an Advocate and apart from this case, he is having one previous case of similar in nature, which was registered in Crime No.383 of 2020 on the file of the Kumbakonam Taluk Police Station for the offences under Sections 4(1)(a)(A) and 4(1)(G) of TNP Act.

5.Considering the nature of offence and the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner or to accord permission to withdraw the petition.

6. Accordingly, this Criminal Original Petition stands dismissed.
