Respondents Prayer : This writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order dated 23.08.2017 in Na.Ka.No.171/2017 issued by the 3rd respondent and quash the same as illegal and consequently direct the respondents to appoint the petitioner as Mini Anganwadi Organiser in Periya Pattamangalam Centre, Kavathukudi Panchayat, Avudaiyarkovil Taluk, Pudukkottai District.

The petitioner is a widow. She belongs to priority category. She also belongs to backward community. She is a candidate for the post of Mini Anganwadi Organiser in Periya Pattamangalam Centre. https://hcservices.ecourts.gov.in/hcservices/ 2.The only ground on which her case has been rejected is that she is over aged. As per G.O.Ms.No.110, Social Welfare and

Nutritious Meal Programme (SW7) Department dated 14.05.2012, the candidate must be within the age group of 25 and 35. For widows, there is age relaxation for further 5 years. But, the writ petitioner is above 40. On this ground, the order impugned in this writ petition has been passed. Therefore, this Court is not in a position to interfere with the same. However, taking note of the observations made in the order dated 11.09.2014 in W.P.(MD) No.1401 of 2014, liberty is given to the petitioner to move the respondents for relief. If the respondents are in a position to grant age relaxation to the petitioner, she can certainly be appointed. The learned counsel for the petitioner submits that the writ petitioner is the only candidate for the post in question. 3.This writ petition is disposed of with the above observation. No costs. Consequently, connected miscellaneous petition is closed..
