Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 353 and 506(ii) I.P.C in Crime No.142 of 2018 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 18.12.2018, the Revenue Officials have distributed Gaja Cyclone relief things to the Village people. The petitioner's name was not included in the list, due to which the petitioner abused the de-facto complainant, who is a Revenue Official and threatened him with dire consequences. Thereby he sustained injuries. Hence, the complaint.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate [Criminal Side] appearing for the respondent.

4. According to the petitioner, he is an innocent person and he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case.

5. The learned Government Advocate [Criminal side] for the respondent submitted that no one sustained injury in that occurrence.

6.Considering the facts and circumstances of the case and also considering the fact that there was a wordy quarrel and no one sustained injury in that occurrence, this Court is inclined to grant Anticipatory Bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Pattukkottai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a likesum to the satisfaction of the learned Judicial Magistrate, Pattukkottai concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30.am., until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
