PRAYER:

Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus to forbear the respondents from interfering with the peaceful functioning of the Madharasha at Al-Hudah Madharsha Palli, Mahar Nonbu Pottal Road, Ramanathapuram.

O R D E R

This writ petition has been filed for issuance of a Writ of Mandamus to forbear the respondents from interfering with the peaceful functioning of the Madharasha at Al-Hudah Madharsha Palli, Mahar Nonbu Pottal Road, Ramanathapuram. 2.Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents.

3.The learned counsel appearing for the petitioner submitted that the elders and women folk want permission and police protection for offering their prayer during Bakrid and hence, the second respondent may be directed to permit them to offer their prayer any time before 05.00 p.m. on 02.09.2017. 4.Considering the grievance of the women folk of muslim community, the second respondent is directed to consider the representation of the petitioner and if necessary, give permission and police protection for the women and children of muslim community to offer their prayer at least for an hour on 02.09.2017 at Al-Hudah Madharsha Palli, Mahar Nonbu Pottal Road, Ramanathapuram. When the permission is granted by the second respondent, the petitioner and their men shall ensure absolute peace in the area in which the Madharasha is located. The petitioner or a representative of the petitioner shall be permitted to see the second respondent and an order shall be passed before 12.00 p.m. today.

5.With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected Writ Miscellaneous Petition is closed.
