ORDER : The Court made the following order :- The petitioner/accused, who was arrested and remanded to judicial custody on 27.02.2026, for the offences punishable under Sections 1/6

103(1), 311 of BNS, 2023 @ 103(1), 190, 191(2), 310(3), 311, 49 and 61(2) of BNS, 2023, in Crime No.75 of 2026, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 19.02.2026, the petitioner along with other accused were staying in a cottage at Kodaikanal. They were in drunken stage and they have created a problem with the deceased. They have tied the deceased in the cottage, murdered him and looted 2 sovereigns of gold chain and 1 1⁄2 sovereigns of gold ring and escaped from the scene of occurrence. Hence, this case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent and she has not committed any offence as alleged by the prosecution. There is no eye witness to the occurrence that the petitioner was available at the scene of occurrence at the relevant point of time. Even according to the prosecution, the petitioner and other accused was said to have stayed at the cottage on 19.02.2026 and vacated on the very next day itself. According to the learned counsel, CCTV reveals that the petitioner was falsely implicated in this case. The petitioner is in jail from 27.02.2026. The earlier application filed by this 2/6

petitioner was dismissed by this Court, by its order, dated 08.04.2026 and this is the second application filed by this petitioner for grant of bail.

The learned Additional Public Prosecutor submitted that the specific overt act as against this petitioner is that she went to the scene of occurrence one day prior to the occurrence and noted down the surroundings. The petitioner along with the other accused conspired together and committed the crime. Therefore, he strongly objected for grant of bail to this petitioner.

5.Taking into consideration of the facts and circumstances of the case and also considering the period of incarceration suffered by the petitioner, this Court is inclined to grant bail to the petitioner, subject to the following conditions:

6. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate Court No.II, Kodaikanal and on further conditions 3/6

that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.

[b] the petitioner shall report before the respondent police daily at 10.30 a.m, until further orders. The petitioner is directed to co-operate for the investigation.

[c] the petitioner shall not abscond either during investigation or trial.

[d] the petitioner shall not tamper with evidence or witness either during investigation or trial. [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
