ORDER

The petitioner is Accused No.4 in Crime No.54 of 2020 on the file of the Thondi Police Station, Thiruvadanai Taluk, Ramanathapuram District. He filed a petition before this Court in Crl.O.P.(MD)No.5190 of 2024 seeking a 1/4

direction to the Inspector of Police, Thondi Police Station, Thiruvadanai Taluk, Ramanathapuram District, to complete the investigation in Crime No.54 of 2020 within a stipulated time.

2. When the petition in Crl.O.P.(MD)No.5190 of 2024 was taken up for hearing on 04.04.2024, the learned Government Advocate (Crl. Side) submitted that the investigation was almost completed and final report would be filed within a period of four weeks. Recording the submission made by the learned Government Advocate (Crl. Side), the said petition was disposed of, by order dated 04.04.2024.

3. Now, the present Contempt Petition is filed that the earlier order of this Court dated 04.04.2024 has not been complied with and final report in Crime No.54 of 2024 has not been filed.

4. When this contempt petition is taken up for hearing, the learned Government Advocate (Crl. Side) takes notice for the respondent and submits that the accused No.5 in Crime No.54 of 2020 has filed a quash petition before this Court in Crl.O.P.(MD)No.8322 of 2020 and the same was allowed by this Court by order dated 04.08.2023. This has been understood by the respondent Police as if the entire case has been quashed by this Ho'ble Court and 2/4

thereafter, they have filed a negative report before the concerned Judicial Magistrate Court. The same has been reviewed by the Superintendent of Police, who in turn directed the respondent Police to file an application, before the concerned Judicial Magistrate, under Section 173(8) Cr.P.C. to reopen the case and to conduct further investigation. As per the direction of the Superintendent of Police, now, they are intending to conduct further investigation by getting necessary permission from the concerned Judicial Magistrate.

5. Recording the submissions of the learned Government Advocate (Crl. Side), this Contempt petition is closed. 30.08.2024 ogy NCC : Yes / No.
