ORDER
This writ petition has been filed for Mandamus seeking for a direction to the the 2nd respondent to release the entire amount from the Bank Account of the petitioner's husband bearing SB Account No.33191087206 to the petitioner.
2.Heard Mr.V.Kannan, learned counsel for the petitioner. 3.Considering the nature of the prayer sought for by the petitioner in this writ petition, this writ petition is taken up for final disposal at the admission stage itself. 1/3
4.It is the case of the petitioner that her husband Mr.Vijayan, retired from the service of the second respondent bank on 13.09.2013. He had a savings bank account in SB Account No.33191087206, at Ilayangudi Branch of the second respondent Bank. According to the petitioner, after the demise of her husband Mr.Vijayan, she approached the second respondent bank to release the entire amount from the bank account of her husband to the petitioner. According to the petitioner, she also gave a representation on 28.09.2020 to the second respondent to release the amount from her husband's account. According to the petitioner, till date no response has been received. In such circumstances, this writ petition has been filed.
5.The relief sought for by the petitioner is an innocuous relief. No prejudice will be caused to the respondents, if the relief sought for in this writ petition is granted in favour of the petitioner. The petitioner only seeks for a direction to the second respondent to release the entire amount from the bank account of the petitioner's husband bearing SB Account No.33191087206, to the petitioner, based on the petitioner's representation, dated 04.09.2019.
6.For the foregoing reasons, this Court directs the second respondent to consider the petitioner's representation dated 04.09.2019, seeking for realization of the entire amount lying to the credit of the petitioner's husband Mr.Vijayan at the second respondent bank bearing SB Account No.33191087206 and pass final orders, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. 7.With the aforesaid direction, this writ petition is disposed of. No costs.
