This writ petition is filed seeking for issuance of a Writ of Mandamus directing the respondents to return the original property document No.805/1990 (sale deed) given by the petitioner in connection with loan transaction No.439035264 forthwith, on the basis of his representation dated 22.08.2017. 2.Heard Mr.V.Thirumal, learned counsel appearing for the petitioner and Mr.Palaramasamy, learned Standing Counsel, who took notice for respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.Learned counsel appearing for the petitioner would submit that the petitioner availed financial assistance from the respondent bank on 31.05.2002 and in the Lok Adalat held on 18.02.2017, the respondent has agreed to receive a sum Rs.55,000/- towards full and https://hcservices.ecourts.gov.in/hcservices/
final settlement. After payment, the respondent has not returned the original documents. Hence, the petitioner sent a representation to the respondents on 22.08.2017. Since no action was taken, the present writ petition.
4.Mr.Palaramasamy, learned standing counsel appearing for the respondents would submit that the respondents have to get no objection certificate from the Reliance and after getting no objection, the respondents would return the original documents. 5.In view of the above submission, the respondent bank is directed to return the original documents to the petitioner within a period of four weeks from the date of receipt of the 'No Objection Certificate'.
6.With the above direction, this Writ Petition stands disposed of. No costs.
