PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the second respondent to execute the Non Bailable Warrant against the third respondent on the basis of the order dated 10.12.2018 of learned Fast Track Court No.II, Madurai in STC No.203 of 2016 within the stipulated time. This petition has been filed to direct the second respondent to execute the Non Bailable Warrant against the third respondent on the basis of the order dated 10.12.2018 of learned Fast Track Court No.II, Madurai in STC No.203 of 2016 within the stipulated time.
2.When the matter is taken up for hearing, the learned counsel appearing for the petitioner would submit that the case was registered for the offences punishable under Section 138 of NI Act and it was taken on file in STC No.203 of 2016. Because of the non appearance of the accused/third respondent, Non Bailable Warrant was issued against the defacto complainant on 10.12.2018. It is seen that till now it has not been executed by the second respondent.

Crl.O.P.(MD)No.12475 of 2021 4.Recording the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is allowed with a direction to the second respondent to execute the Non Bailable Warrant that has been issued against the third respondent herein within a month from the date of receipt of a copy of this order and after that compliance report must be submitted to the Registry of this Court.
