2. The learned Additional Public Prosecutor submitted that it is true that the petitioner was deleted from the array of accused on conclusion of investigation by filing final report in C.C.No.324 of 2023 before the learned Judicial Magistrate Court at Usilampatti. However, the de facto complainant had filed Crl.MP.No.107 of 2023, protesting the deletion of the petitioner's name from the array of accused, and the same is still pending. Until and unless the same is disposed of by the learned Trial Court, the question of issuing no objection certificate to the petitioner, as no case is pending, will not arise.
3. Heard either sides and carefully perused the materials available on record.
4. Considering the fact that the petitioner was earlier selected in Indian Navy, which job opportunity was lost by him due to the police verification report, citing the pendency of this case, this Court is of the considered view that the pending Crl.MP.No.107 of 2023 on the file of the learned Judicial Magistrate, Usilampatti, in C.C.No.324 of 2023 should be disposed of immediately. Therefore, the learned Judicial 3/6
Magistrate, Usilampatti, is directed to dispose of Crl.MP.No.107 of 2023 in Crime No.67 of 2022 as expeditiously as possible within a period of two weeks from the date of receipt of a copy of this order.
5. With the above said direction, this Writ Petition is disposed of. No costs.
