O R D E R

This Criminal Original Petition has been filed to direct the third respondent not to interfere in the matrimonial dispute, on the basis of the complaint of the fourth respondent.

2.The learned counsel appearing for the petitioner submitted that the petitioner is now residing at Madurai and the fourth respondent is his wife and she gave a complaint against the petitioner. Based on that, the third respondent Police has interfered and disturbed the petitioner. Hence, the present Writ Petition has been filed.

3.The learned Government Advocate (Crl. Side) appearing for the respondent Police submitted that a complaint has been received from the fourth respondent and the third respondent has issued C.S.R.No.165 of 2022 and the petitioner has not cooperated with the enquiry and summon has been issued to him.

4.Considering the submission made on either side, this Court finds that in the matrimonial dispute if any offence is involved, the respondent Police has power to register the case and investigate the same. Therefore, this petition, seeking direction not to interfere with the matrimonial dispute, is unsustainable.
