PRAYER:

Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondent herein to select the petitioner for admission for L.L.B. (Academice) Course in Annamalai University through Correspondence, for academic year 2016-17 by considering his application No.108445 within the time limit fixed by this Court without insisting for a degree in 10+2+3 pattern. ORDER

The prayer sought for in this writ petition is for issuance of a Writ of Mandamus, directing the respondent to select the petitioner for admission for L.L.B. (Academic) Course in Annamalai University through Correspondence, for academic year 2016-17 by considering his application No.108445 within a time period.

2. Heard Mr.AL.Kannan, learned counsel for the petitioner and Mr.G.Muthu Kannan, learned Government Advocate for the respondent.

3. According to the petitioner, after completing 10th Standard, he studied I.T.I Mechanic (Motor Vehicle) during August 1997 to July 1999. Thereafter, he completed B.A. in Open University under distance education programme. He belongs to Backward Community.

4. The petitioner would further state that the respondent university is offering L.L.B. Course through correspondence. He applied for L.L.B. Course vide Application No.108445. But the respondent refused to receive the same stating that he did not undergo 10+2+3 pattern.

The petitioner would state that as per G.O.(Ms.)No.242, Higher Education Department, dated 18.12.2012, if a person studied diploma course for a period of two years after 10th standard and after that if the person obtained a degree, the same shall be treated as he had undergone 10+2+3 pattern, so he is eligible to join the course.

6. The learned counsel for the petitioner submitted that it would suffice, if a direction is given to the respondent to consider the application of the petitioner in the light of the above G.O.(Ms.)No.242, Higher Education Department, dated 18.12.2012.

7. The learned Government Advocate would submit that the petitioner is entitled for the admission of L.L.B. Course, as per G.O.(Ms.)No.242, Higher Education Department, dated 18.12.2012. However, for the academic year 2016-17 admission was already over, if the petitioner approaches the respondent for joining the course for next academic year, the application will be considered.

8. In view of the above submissions, the petitioner is permitted to seek admission for L.L.B. Course in Annamalai University through correspondence for the academic year 2017-2018. In such event, the respondent shall provide admission, if he is otherwise qualified.
