ORDER

The petitioner has submitted an application under the Patta Passbook Act before the first respondent / Tahsildar on 01.04.2023 for patta and has filed this writ petition that his application has not been considered. 2.Learned Additional Government Pleader appearing for the first respondent submitted that on the application of the petitioner, enquiry is being conducted and that a decision would be taken within a reasonable time.

3.Learned Counsel appearing for the second respondent submitted that the second respondent is having a title over the subject property, however, the petitioner is attempting to get patta behind his back. 2/4

4.Considering the rival submissions made, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's application dated 01.04.2023 and pass appropriate orders thereon, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner and the second respondent, within a period of twelve weeks from the date of receipt of a copy of this order. The second respondent shall appear before the first respondent / Tahsildar for enquiry on 16.08.2023 and shall co-operate for the enquiry. There shall be no order as to costs.
