This writ petition has been filed seeking issuance of a writ of mandamus, directing the respondents 1 and 2 not to survey and demarcate the land in SF.No. 573/1C of Sholavandhan Village, Vadipatti Taluk, Madurai District, which belongs to the third respondent without putting the petitioner and other adjacent land owners on notice based on the representation dated 02.05.2025 and in consonance with Section 10(1) of The Tamilnadu Survey and Boundaries Act, 1923, within the time frame.

2. Heard the learned counsel for the parties.

3. The petitioner submitted a representation dated 02.05.2025 to respondents 1 and 2 requesting that no survey be conducted in respect of the properties referred to above. As the said representation has not been considered till date, the present writ petition has been filed. 2/5

4. The learned Government Advocate, appearing on behalf of respondents 1 and 2, submitted that the survey would be conducted on merits and in accordance with law, after recording the objections raised by the petitioner and all other interested persons in respect of the subject property.

5. In view of the above submission, this writ petition stands disposed of with a direction to the first respondent/Tahsildar to conduct the survey on merits and in accordance with law, after issuing notice to the petitioner, the third respondent and the owners of relevant adjacent lands and recording the objections raised by them, if any and thereafter pass appropriate orders in compliance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order.
