PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to 3rd respondent proceedings made in application number 04/KA.A/THO.VA/CHI.MA.KA/2025, dated on 05.05.2025, quash the same and further direct the 3rd respondent to grant permission and necessary protection to perform the cultural program (ie) Adal padal on 12.05.2025 at 07.00 PM to 10.00 PM in front of temple in the event of Sri Mariyamman and Sri kaliyamman Kovil Thiruvizha at Vazvarmangalam, Karur District, in the light of petitioner's representation dated 05.05.2025, within a stipulated period as may be fixed by this Court.

O R D E R
This Writ Petition has been filed seeking to quash the proceedings issued by the third respondent in Application No. 04/KA.A/THO.VA/CHI.MA.KA/2025, dated on 05.05.2025 and to direct the third respondent to grant permission and necessary protection to 2/7
perform the cultural program (ie) Adal padal on 12.05.2025 at 07.00 PM to 10.00 PM in front of temple in the event of Sri Mariyamman and Sri kaliyamman Kovil Thiruvizha at Vazvarmangalam, Karur District, in the light of petitioner's representation dated 05.05.2025.

The petitioner would contend that every year during the celebration of the festival, they used to conduct Pongal, Palkudam, Poo mithital, Maavilakku Pooja, organize dance, drama, Orchestra etc. For the current year, the festival is proposed to be held between the period from 11.05.202 to 13.05.2025. One of the features of the function is a cultural event, which is styled as "Adal Padal" to be held on 12.05.2025. The petitioner would submit that he has made a representation to the respondents to grant permission to conduct the said cultural festival. The permission was declined by the third respondent citing the possibilities of law and order issues. Hence, the writ petition.
3. Heard the learned counsel on either side.
4. In the affidavit filed in support of the writ petition, there is no iota of a pleading that a fundamental right has been breached. Therefore, 3/7
on this ground, the writ petition appears to be misconceived.

It is brought to the notice of this Court that pursuant to the various orders of this Court, the Director General of Police, Tamil Nadu issued two circulars bearing Rc.No.159539/Crime.4(3)/2018, signed on 31.10.2018 and Rc.007301/GenlI(1)/2019, dated 09.04.2019 setting out the conditions to be imposed before permission is given for the Adal Padal program. One Jeisankar filed writ petition in W.P.(MD).No.12490 of 2023 and the same was allowed subject to some conditions. It is reported that no untoward incident took place in the earlier occasion i.e., last year cultural program. Hence, this Court is inclined to set aside the impugned order and grant permission to conduct "Adal Padal" subject to the following conditions.
(a) The impugned order passed by the third respondent vide 04/KA.A/THO.VA/CHI.MA.KA/2025 dated on 05.05.2025 is set aside. (b) Adal Padal program shall not extend beyond 10 p.m. (c) No men or women participating in the cultural program would be depicted or portrayed in an obscene or undignified manner either in 4/7
the form of clothing or otherwise;.
(d) The music that shall be used shall be in sync with the precincts of the temple and double meaning songs should not be played; (e) There shall be no supply of alcohol or any intoxicating material in and around the area where cultural program is scheduled to be held;
8. In case of violation of any conditions, it is open to the authorities to initiate such action as is required under law and the persons who are the organisers/committee members shall be held responsible. 9.With the above observations and directions, this writ petition is ordered.
