ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 18.03.2025 for the offences punishable under Sections 8(c) r/w 20(b)(ii) (c), 25 & 29(1) and 25 of Narcotic Drugs & Psychotropic Substances Act, in Crime No. 244/2024 on the file of the Respondent Police, seeks bail.

2. The case of the prosecution is that the petitioner along his friends were in illegal possession of 21 kilograms of Ganja . Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court and he is in judicial custody from 18.03.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that this case involves seizure of 21 kilograms of Ganja, which was seized only 2/5

from the petitioner and also submitted that two previous cases are pending against the petitioner.

5. The petitioner seeks bail on medical grounds. Therefore, this Court directed the respondent police to assess the petitioner's health condition and submit a report before this Court.

Pursuant to the directions of this Court, the respondent police submitted a report stating that the petitioner has been receiving proper medical treatment and that his condition is now stable and he is doing his routine activities. Therefore, the petitioner's request for bail on medical grounds is rejected. Further the petitioner was arrested while in possession of the contraband and there are two previous cases are pending against the petitioner, this is not a fit case for the grant of bail.

7. Accordingly, this Criminal Petition is dismissed. (S S Y J) 20.02.2026 tta 3/5
