PRAYER :- For Bail in Crime No.255 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 26.04.2025 for the offences punishable under Sections 296(b), 115(2), 118(1), 351(3) of the BNS, 2023 and Section 25(1A) of the Arms Act, 1959 in Crime No.255 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused have abused the defacto complainant with filthy language and assaulted him by using stones and sword, and also threatened him with dire consequences and possessed with dangerous weapon. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in custody from 26.04.2025. Hence, he seeks bail.

4. The learned Additional Public Prosecutor would submit that 6 previous cases are pending against the petitioner and he is a habitual offender. He would further 2/4

submit that the petitioner was detained under Act 14 of 1982. Hence, he vehemently opposed to grant bail to the petitioner.

5. Heard the learned counsel on either side. Perused the documents placed on record.

6. Taking into consideration the facts and submissions made by the learned counsels and the fact that the petitioner is a habitual offender against whom there are 6 previous cases and the petitioner was detained under Act 14 of 1982, this Court is not inclined to grant bail to the petitioner.
