For Respondent : Mr.P.Kottai Chamy Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.444 of 2020 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 379 IPC r/w Section 21(1) of the Mines and Minerals (Development and Regulation)Act, 1957, in Crime No.444 of 2020, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused have illegally transported one unit of river sand by using Tractor and Trailor bearing Registration No.TN-67-9824. Hence, the present case has been registered.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that the petitioner and other accused have illegally transported one unit of river sand and on the complaint of the Police officials, the case was registered. He further submitted that the following four other cases are pending against the petitioner, out of which, two cases are of similar in nature.

5.Taking note of the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
