For Respondent : Mrs.M.Anandha Devi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.9 of 2020 on the file of the respondent police ORDER : The Court made the following order :- Apprehending arrest at the hands of the respondent police in Crime No.9 of 2020 for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code, the petitioner has come up with the present petition seeking anticipatory bail under Section 438 of the Code of Criminal Procedure.
2. Heard both sides.
3.The allegation is that the petitioner was working as Accountant in Kulithalai Municipality and she has misappropriated the amount to the tune of Rs.59,73,435/- [Rupees Fifty Nine Lakhs and Seventy Three Thousand and Four Hundred and Thirty Five only] from the pension account, GPF account and contributory pension account and the same was found out during local fund audit. The enquiry reveals that the petitioner misused the funds by issuing cheques in the individual name and misappropriated the amount. Hence, the complaint has been filed.

CRL OP(MD). No.11711 of 2020 4.From the perusal of records, it is seen that the public fund has been misappropriated to the tune of Rs.59,73,435/- [Rupees Fifty Nine Lakhs and Seventy Three Thousand and Four Hundred and Thirty Five only], investigation is still pending.
5.This is the second anticipatory application. Considering the facts and circumstances of the case and there is no change of circumstances to entertain this application and the fact that investigation is still pending, this Court is not inclined to grant anticipatory bail to the petitioner.
