O R D E R

This Writ Petition has been filed seeking to quash the rejection order dated 02.05.2025 passed by the second respondent and direct the respondents to grant permission and protection for conducting Adal Padal Program scheduled to be held on 13.05.2025 between 6.00 pm and 10.00 pm in connection with Thiruvizha Arulmigu Shri Muthu Mariamman Thirukovil, Melur Village, Srirangam, Trichy District. 2.The learned Counsel for the petitioner submits that this Court has granted permission for Adal Padal programmes in earlier occasions and he has relied on several judgments including a Division Bench Judgment and prayed for setting aside the impugned order with a direction to the respondent police to grant permission to conduct Adal Padal programme during the temple festival. Further he submits that the petitioner side is ready to conduct the programmes following the 2/7

conditions to be imposed by the Court. Accordingly, he prays to to allow the writ petition.

3.Mr.A.Thiruvadi Kumar, the learned Additional Public Prosecutor has raised serious objections that this Adal Padal programme as it is being usually are conducted with obscenity and it promotes vulgarity. Therefore disputes arise among the organisers, villagers and the public leading to registration of several criminal cases. Several such incidents had occurred during such Adal Padal programme. The learned Additional Public Prosecutor further submits that when permission for Adal Padal programme is granted with certain conditions, the conditions are not scrupulously followed. It is very difficult to implement the conditions with the available limited police force. He pointed out that the authorities have granted permission for temple festival except for Adal Padal programme and also assured to extent police protection. Apprehending law and order issue, the respondent-police has denied permission for Adal Padal programme. Accordingly, he prayed to dismiss the writ petition.

This Court, since has already entertained such writ petitions seeking permission for Adal Padal programmes and has also granted permission by imposing several conditions, and also considering the circulars issued by the Director General of Police in RC No. 007301/Gen I(L)/2019, dated 09.04.2019 and RC.No. 159539/Crime4(3)/2018, dated 31.10.2018, does incline to set aside the impugned order. Accordingly the impugned order is set aside and permission is granted to conduct Adal Padal programme subject to the following conditions:- (a) The impugned order passed by the second respondent dated 02.05.2025 is hereby set aside.

(b) Adal Padal program shall not exceed beyond 10.00 p.m. (c) No men or women participating in the cultural program shall be depicted or portrayed in an obscene or undignified manner either in the form of clothing or otherwise;

(d) The music that shall be used shall be in harmony with sancity of temple precinct and double meaning songs shall not be played; 4/7

(e) There shall be no supply of alcohol/liquor or any intoxicating material in or around the area where cultural program is scheduled to be held;

6. In case of violation of any conditions, it is open to the authorities to initiate such action as required under law and the persons who are the organisers/committee members shall be held responsible.

7. With the above observations and directions, this writ petition is ordered.
