Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 and 2 to remove the encroachment of the pathway comprised in Survey Nos.985, 988, 989, 969, 991/1, 993 situated at Boomparai Village, Kodaikanal Taluk, Dindigul District by taking necessary action based on the petitioner's representation dated 24.04.2017.

[Order of the Court was made by M.SATHYANARAYANAN, J.] The learned counsel appearing for the petitioner, on instructions, would submit that the petitioner's prayer is answered at last in the form of survey and measurement of the pathway and therefore, the petitioner is not interested in prosecution this writ petition.

2. The learned counsel appearing for the respondents prays for time to get instructions as to the latest position.

3. If the encroachment is removed already, the second respondent shall ensure that there is no new or re-encroachment takes place in respect of the lands in question.
