ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 392, 397, 506(ii) of IPC @ 392, 397 and 506(ii) of IPC r/w 109 of IPC in Crime No.1396 of 2017, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant was working in a SPA Centre. The accused persons attacked the defacto complainant and other employees of the SPA Centre with sword and also threatened them. They also snatched the mobile phones and a handbag. The defacto complainant was injured and was admitted in the hospital. Hence, the complaint.

3. The learned Counsel for the petitioner would submit that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. He therefore prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that the petitioner was absconding and had not appeared before the Committal Court. The Committal Court has issued non bailable warrant against the petitioner in PRC No.206 of 2023, pending on the file of the Judicial Magistrate Court No.6, Madurai.

5.The learned Counsel appearing for the petitioner undertakes that the petitioner would appear before the Court below regularly on all future hearings without fail.

6. Considering the undertaking given by the learned Counsel appearing for the petitioner, the petitioner is directed to appear before the Judicial Magistrate Court No.6, Madurai, on the next hearing date, ie., on 21.05.2025 and to file a petition to 2/4

recall the non bailable warrant which was already issued against the petitioner. On filing of such petition, the learned Judicial Magistrate is directed to consider the case on merits and pass orders on the same day. It is made clear that while considering the petition to recall the non bailable warrant, the Court below shall bear in mind about the period of the non bailable warrant and the crime committed. The mere direction issued by this Court to consider the case on the same day does not amounts to consider the petition to recall the non bailable warrant favorably.

6. Accordingly, the petition is disposed of.
