O R D E R

This writ petition is for directing the respondents to grant permission for conducting Marathon Race and taking out a procession on 10.09.2017 at about 8.00 A.M., from Kattuputhur Bus Stand to Madurai Kaliamman Temple, Thottiyam in Tiruchirappalli District.

2.The Petitioner states that he is an alumnae of the Jameendhaar High School, Kattuputhur Village. All the boys studied in the school are running armature alumni association in the name of "New Creative Freedom Indian Group". https://hcservices.ecourts.gov.in/hcservices/

3.The petitioner further states that he is the President of the said Association. He also states that this Association is conducting Marathon Race to create social awareness among the people, relating to socio economic issues like prohibition, obeying to traffic rules and agriculture etc. 4.It is further stated by the petitioner that the petitioner's Association was given permission from 2014 to conduct such Marathon Race. Though, the third respondent granted permission earlier by order dated 12.06.2017 to conduct Marathon Race on 20.08.2017 and 21.08.2017, the permission was denied later by an order dated 19.08.2017.

5.It is in the said circumstances, the petitioner states that fresh representation was given to the respondents on 26.08.2017. Considering the facts narrated by the petitioner in the affidavit filed in support of this writ petition, and that there is no serious objections raised by the respondents with regard to the factual contentions of the petitioner, this Court is of the view that such permission can be granted to the petitioner. 6.The respondents are directed to consider the petitioner's representation dated nil sent on 26.08.2017 and pass appropriate orders on merits and in accordance with law subject to any reasonable restrictions or conditions, so as to ensure law and order, convenience of public and other aspects. The representation of the petitioner shall be considered on or before 09.09.2017.
