PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent No.3 and 4 to not to interfere the civil dispute in respect of C.S.R.No.38 of 2022 on the file of the third respondent. The writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondent No.3 and 4 to not to interfere the civil dispute in respect of C.S.R.No.38 of 2022 on the file of the third respondent.

2.Mr.M.Sakthi Kumar, learned Government Advocate (Criminal Side) takes notice for the respondents 1 to 3. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.When the matter is taken up for hearing today, the learned Government Advocate (Crl. Side) appearing for the respondents 1 to 3 submitted that one Nagachandran and 40 people of Maniyapillai Village gave a complaint against this petitioner before the third respondent Police against this petitioner and the third respondent Police has issued C.S.R.No.38 of 2022 alleging that the petitioner has damaged the Public Road namely Rani Mankammal Salai. Since the petitioner being an accused and case is civil in nature, this petition is not maintainable. Hence, he prayed to dismiss the petition.

4.On perusal of the materials available on records, it is seen that the petitioner/accused has damaged the Rani Mankammal Salai and caused trouble to the village people of Maniyapillai and all the village people through Nagachandran, gave a complaint against the petitioner for taking action. Hence, the third respondent Police has investigated in C.S.R.No.38 of 2022.

5.Under these circumstances, this Court finds no merit to entertain this petition. Hence, this Writ Petition is disposed of. No costs. 06.07.2022 Index :Yes/No Internet:Yes/No vsg 3/5
