ORDER
This Petition is filed to relax the condition No.2 imposed on the petitioners in Cr.M.P.No.1999 of 2024 on the file of Principal District and Sessions Judge, Trichy, dated 05.04.2024.
2. This Court considered the rival submissions made.
3. It appears that the petitioners were granted anticipatory bail by the Principal District and Sessions Judge, Tiruchirappalli, in Cr.M.P.No. 1999 of 2024, on 05.04.2024. Thereafter, they had filed an application to modify the condition before the concerned Court on medical grounds. However, they have failed to produce medical certificate and therefore, the application filed by the petitioners for modification was dismissed by the Principal District and Sessions Court in Cr.M.P.No.2726 of 2024 on 10.06.2024. Without challenging the modification order, the petitioners have filed this application, to relax the condition No.2 imposed on them in Cr.M.P.No.1999 of 2024.
4. Since it is the learned Principal District and Sessions Judge, 2/4
Trichy, who has imposed the condition, he must be knowing as to the circumstances under which the condition was imposed and the circumstances under which for modification the petition was dismissed. Therefore, this Court is not inclined to interfere with the orders of the Principal District and Sessions Judge, Tiruchirappalli.
5. Accordingly, this Petition is dismissed. It is open to the petitioners to file a fresh application before the Principal District and Sessions Court, Trichy.
