RESPONDENT/ COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to permit the petitioner to file the bail petition directly before this Honourable Court without approaching the Principal Sessions Court, Theni and thus render justice.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.S.ALAGUSUNDAR, Advocate for the petitioner and of Mr.K.SUYAMBULINGA BHARATHI, Government Advocate(Crl.Side) on behalf of the Respondent, the court made the following order:- The learned counsel for the petitioner filed this petition seeking to approach this Court for bail without approaching the learned Principal Sessions Court, Theni. Earlier, this Court had cancelled the anticipatory bail to the petitioner and thereafter, he was remanded to judicial custody.

2. When this Court about to dismiss this petition, the learned counsel for the petitioner seeks permission of this Court to withdraw the petition and he has also made an endorsement to that effect. In view of the endorsement made by the learned counsel for the petitioner, the Criminal Miscellaneous Petition is dismissed as withdrawn with liberty to the petitioner to move the Sessions Court for seeking bail.
