PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st and 2nd respondents to survey the land comprised in Survey No.1107/4A at Thevaram Village, Uthamapalayam Taluk, Theni District by considering the petitioner's representation dated 16.03.2024 within time frame fixed by this court. For Petitioner : M/s.K.Prakash For Respondents : Mr.K.Balasubramani Special Government Pleader for R1 & R2 No appearance for R3 1/4

ORDER

By this writ petition, the petitioner seeks conduct of survey of the land in S.No.1107/4 at Thevaram Village.

2. Learned Special Government Pleader has placed on record servey certificate dated 19.07.2023. By referring to a communication from the Surveyor, he points out that it is recorded therein that the petitioner refused to sign in acknowledgement.

3. In these circumstances, the relief claimed in this writ petition cannot be granted. If the petitioner is aggrieved by the survey conducted earlier, it is open to the petitioner to approach the Assistant Director of Survey by way of appeal.
