For Respondent : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 1323 of 2017 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/Accused No.4, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 341, 294(b), 324 and 506(ii) I.P.C, in Crime No.1323 of 2017 on the file of the respondent police, seeks anticipatory bail. 2.When the matter is taken up hearing, the learned counsel for the petitioner would submit that after investigation, final report was filed before the learned Judicial Magistrate-IV, Madurai, and it was taken on cognizance in C.C.No.315 of 2018. Because of the non appearance of the petitioner before the Trail Court on 14.12.2022, warrant was issued and he is not in a position to arrange the lawyer on that date. That was the reason for his non-appearance. On that ground, he seeks anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis
3.The petitioner may surrender before the Trial Court and get the warrant recalled. Considering the facts and circumstances of the case, granting anticipatory bail may not arise since already he was released on bail.
4.With the above direction, this Criminal Original Petition is dismissed.
