PRAYER :- For Bail in Crime No.114/2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A5, who was arrested and remanded to judicial custody on 20.04.2023 for the offences punishable under Sections 147, 148, 294(b), 336, 341, 342, 323, 302 and 506(ii) IPC in Crime No.114 of 2023 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that there was a wordy quarrel, during adal padal function in Odukampatti Village, in which, A1 thrown the stones on the people in the crowd and due to which, one person got injured. On the same day, A1 and A2 were roaming outside in a two wheeler and at that time, the de-facto complainant and the deceased Vigneswaran came on that side. Suddenly, A1 attacked the deceased Vigneswaran with iron rod and other accused surrounded the said Vigneswaran by not letting him escape from the place. Hence, the case.

3.Heard. Perused the materials available on record including the First Information Report.
4.It is seen that there are named 7 accused and others are involved in this case. During temple festival, there was a dispute between them, due to which, the accused persons had brutally attacked the deceased to do away the life of the deceased. Therefore, he sustained grievous injuries and died. The petitioner was arrested only on 20.04.2023. Investigation is still pending. That apart, the respondent had sent proposal for detaining the petitioner under the Goondas Act.
5.Taking into consideration the seriousness and gravity of the offence and also taking note of the fact that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
