Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, forbearing the respondents from appointing Mini Anganvadi Worker, Anganvadi Worker and Anganvadi Helper in any one of the Anganvadi at Karur District and consequently direct the respondents to call for vide publication as per G.O.Ms.No.110, Social Welfare and Nutritious Meal Programme [SW7] Department, Tamil Nadu Government, dated 14.05.2012 and conduct the interview, publish the results and make further appointment based on the merits of the result in a transparent manner.

O R D E R

*********** [Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner filed this Writ Petition in pro bono publico for issuance of a Writ of Mandamus, forbearing the respondents from appointing Mini Anganvadi Worker, Anganvadi Worker and Anganvadi Helper in any one of the Anganvadis at Karur District and for a further direction to the respondents to call for applications in accordance with the Government Order in G.O.Ms.No.110, Social Welfare and Nutritious Meal Programme [SW7] Department, dated 14.05.2012.

2. The grievance of the petitioner is that the first respondent issued a press statement on 22.08.2017 and on the basis https://hcservices.ecourts.gov.in/hcservices/

of the said statement, applications were submitted by the candidates. It is the case of the petitioner that proper publication was not given by the District Collector and as such, the selection process is vitiated.

3. Mr.M.Govindan, learned Special Government Pleader, on instructions from the respondents, submitted that pursuant to the press statement given by the District Collector, the department received as many as 2475 applications. The concerned authorities interviewed the candidates from 28.08.2017 to 31.08.2017 and published the final list of eligible candidates, on 05.09.2017. The District Administration is in the process of sending appointment orders to the selected candidates.

4. The petitioner has come up with this Writ Petition, after the completion of entire selection process. Nothing prevented the petitioner from approaching this Court at the earliest of point of time. The information furnished by the respondents would indicate that the selection process has already been completed long back and the selected candidates are in the process of joining the service. In case this Court interferes with the selection process at this point of time, it would jeopardize the interest of those who are not before this Court. We, therefore, do not find any reason to interfere with the selection process at this point of time. However, we make it clear that this order would not stand in the way of aggrieved from approaching this Court, challenging the selection process, in case the same was not done in accordance with law.

5. The Writ Petition is dismissed with the above observation. No costs. Consequently, connected Miscellaneous Petition is closed.
