ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 318(4), 318(2), 336(3), 340(2) of BNS,2023 (u/s.420, 417, 468, 471 of IPC), in Crime No. Not Known of 2025, seek anticipatory bail.

2. The case of the prosecution is that based on a complaint filed by the defacto complainant on 10.05.2025 alleging that the petitioners had forged documents to sell her properties to a person named Jayanthi, a case was registered against the petitioners.

3. The learned counsel for the petitioners submits that the petitioners and the defacto complainant are family members who underwent a family partition of the subject properties in the year 1991. The petitioners possess patta for the properties. He further submits that the defacto complainant's grievances, if any, should be addressed before a competent civil court, and therefore, filing a criminal complaint against the petitioners is not maintainable.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submits that a complaint was received against the petitioners and the respondent police have conducted a petition enquiry as against the petitioners in 2/3

CSR.No.586 of 2025 and the same is now closed.
