PRAYER :- For Bail in Crime No.136 of 2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioners / Accused herein, who were arrested and remanded to judicial custody on 15.06.2022 for the alleged offence punishable under Sections 147, 148, 294(b), 342, 307 and 506(ii) IPC in Crime No.136 of 2022, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the de facto complainant is the wife of the injured person. One Kayathiri, who is the daughter of the brother of the injured loved the accused No.2 and on 14.06.2022 she went to the house of the A2. Knowing the above said issue, the defacto complainant and others went to the house of the accused persons and the daughter was taken back by them. When returning to the house about 7.00 pm on the same day, all the accused came to the house of the complainant and quarrelled with them and attacked the husband of the defacto complainant with beer bottle and caused injuries to him. CRL OP(MD). No.12436 of 2022 3.The learned counsel for the petitioner submitted that three co-accused persons have already been surrendered before the concerned Court and the petitioner is in custody from 15.06.2022.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the injured has been discharged from the hospital and that there is no previous motive between them.
5.Considering the period of incarceration and the fact that the injured has been discharged from the hospital and the co-accused have already been surrendered before the concerned Court, this Court is inclined to grant bail to the petitioners with stringent conditions.
6.Accordingly, this Criminal Original Petition is allowed and the petitioners herein are ordered to be released on bail, on condition that each of the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Ambasamudram, and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders.
