For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No. 4 of 2013 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused, who was arrested on 06.10.2021 for the alleged offences under Sections under Sections 406, 420, 120(b) I.P.C., and Section 5 of TNPID Act, in Crime No.4 of 2013 on the file of the respondent police, seeks bail.
2.The learned Additional Public Prosecutor would submit that the petitioner was arrested on 06.10.2021. Ever since he is in custody. Before the Trial Court P.W.1 to 8 were examined on 10.08.2022. But, the petitioner was not engaged Advocate for defence and cross-examining the witnesses. Such sort of activities cannot be encouraged.
3.The petitioner is directed to cross-examine the witnesses by engaging an Advocate. After cross-examination of the above said witnesses, petitioner's bail application can be considered. Even though, undertaking affidavit filed by the petitioner, he is not entitled for bail.
