ORDER

This petition is filed seeking police protection, on the basis of the representation dated 10.08.2021.

2.The learned counsel appearing for the petitioner would submit that the Government assigned patta in S.Nos.339/4A and 354/1 situated at Madakulam, Madurai. The 3rd respondent herein made trouble to the petitioner, for which, the petitioner filed W.P.(MD) No.12641 of 2018 before this Court and status quo order has been passed in this matter. To violate the same, now the 3rd respondent is constructing a house. So, the petitioner made a representation dated 10.08.2021, when trouble was made by the 3rd respondent. 3.The learned Additional Public Prosecutor (Crl.Side) appearing for the respondents 1 and 2 would submit that based upon the complaint given by this petitioner, enquiry was undertaken in CSR.No.637 of 2021 and during the course of enquiry, it was found that in respect of a single property, both the petitioner as well as the 3rd respondent have been assigned pattas. CRL O.P(MD). No.11646 of 2021 find out in whose favour patta has been assigned, the matter is referred to the Special Tahsildar, Adi Dravidar Welfare Board, Land Acquisition, Madurai and the report from the Special Tahsildar is awaited.

4.Since the dispute is existing between the petitioner and the 3rd respondent herein, the question of granting police protection to the petitioner at this juncture may not arise. Depending upon the outcome of the report from the Special Tahsildar, the petitioner is at liberty to workout his remedy before the appropriate forum through appropriate proceedings, if so required. 5.With such liberty, this petition is disposed of.
