Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondent to survey the petitioner's land in S.F.No.472/29 situate in Ponnamaravathy East, Pudukkottai District, on the basis of the petitionerr's representation dated 10.08.2017. ORDER
The petitioner seeks for a direction to the respondent to survey her land in S.F.No.472/29 situated at Ponnamaravathy East, Pudukkottai District, based on her representation, dated 10.08.2017. 2.Heard Mr.K.Baalasundharam, learned counsel appearing for the petitioner and Mr.C.Selvaraj, learned Special Government Pleader, who took notice on behalf of the respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3.The case of the petitioner is that she is the absolute owner of the property in S.No.472/29 situated at Ponnamaravathy East, Pudukkottai District and she has been in possession and enjoyment of the same.
4.The petitioner would submit that in respect of S.No.472/45, a civil suit is pending and in respect of S.No.472/29, there is no litigation and therefore, the petitioner approached the respondents https://hcservices.ecourts.gov.in/hcservices/
to survey the property and also paid necessary fees. Since no action was taken, she sent a representation on 10.08.2017. Despite the same, no action was taken, hence, the present writ petition. 5.Considering the limited scope of the prayer sought for by the petitioner, this Court, without going into the merits of the matter, directs the respondent to consider the representation of the petitioner dated 10.08.2017 and take appropriate action on merits and in accordance with law, after providing opportunity to all necessary parties, within a period of twelve weeks from the date of receipt of a copy of this order.
6.With the above direction, this Writ Petition stands disposed of. No costs.
