PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents herein to dispose of the disciplinary proceedings initiated against these petitioners on 23.08.2016 and also reminder dated 21.08.2017 within the time stipulated by this Court. ORDER

The prayer in this writ petition is for a direction to dispose of the disciplinary proceedings said to be initiated against the petitioners on 23.08.2016.

2.Heard both sides.

3.Upon instructions, the second respondent has filed a counter affidavit, wherein at paragraph No.5, it has been stated as follows: "5.I respectfully submit that the first and second respondents have not given any charge memo to the petitioners. No charges were framed and no enquiry officer was appointed. As per GO mentioned in para No.4, the second respondent sent these proceedings to the petitioners and to the District Elementary Educational https://hcservices.ecourts.gov.in/hcservices/

Officer of Theni on 09.01.2018 mentioning that the District Elementary Educational Officer has to deal this complaint and to take the necessary steps as per the disciplinary proceedings. For the reasons stated above, the claim of the petitioner is not sustainable and maintainable. Hence, the writ petition is liable to be dismissed with costs.".

4.Now, the learned Counsel for the petitioners also accepted the above said averment made in the counter affidavit cited by the second respondent.
