This case came up for settlement before the Lok Adalat. Both the parties present. The counsel for the appellant/s Mr.S.Michel Heldon Kumar and the counsel for the respondent/s 1/4
Ms.K.Shivasankari are present. After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement.
AWARD The Corporation has filed the above appeal challenging the award passed by the Tribunal. Now the parties have arrived at a settlement for a sum of Rs.30,00,000/- (Rupees Thirty Lakhs only) as full quit. The same is recorded.
2. The appellant /Corporation is directed to deposit the said amount within a period of ten weeks from today, less the amount already deposited, if any. If the amount is not deposited within that period, the award amount will carry interest at the rate of 9% from the date of petition till the date of deposit.
3. From the award amount, the first claimant is entitled to withdraw a sum of Rs. 10,00,000/- (Rupees Ten Lakhs only), the second claimant is entitled to withdraw a sum of Rs.15,00,000/- (Rupees Fifteen Lakhs only) and the third claimant is entitled to withdraw a sum of Rs.5,00,000/- (Rupees Five Lakhs only). The first and third claimants/respondents are permitted to withdraw their entire share amount by filing appropriate application before the Tribunal. The share of the minor second claimant shall be deposited in any one of the Nationalized Bank, till the minor attains majority. The first claimant being the mother, is entitled to withdraw the interest once in six months till he attains majority. Counsel for the Respondent/s This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamilnadu Court Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
The Original of the award shall be place in the court record and copy of the award, kept with High Court Legal Services Committee and one copy each is furnished to both parties free of cost.
In agreement of the above, both parties and their counsel have affixed their signatures/ thumb impressions in presence of the Lok Adalat Bench admitting the terms and today conditions and accordingly, the award is passed.
