ORDER
This writ petition has been filed as against the order of the third respondent dated 11.05.2025 rejecting to give permission and police protection for conducting Temple Festival of Arulmigu Sri Jambudurai Amman Temple situated at J.Mettur, Nilakkottai Taluk, Dindigul District.
2.The case of the petitioner trust is that they had Constructed Jambudurai Amman Temple, at J.Mettur, Nilakkottai Taluk, Dindigul District. The petitioner, with the grievance that the fourth respondent is creating some problem for conducting the Temple Festival for this year, has made a request before the respondent police to provide police protection for conducting temple festival. However, the third respondent rejected the request of the petitioner by the order impugned dated 11.05.2025.
3.The learned counsel for the petitioner submits that the petitioner-trust has constructed the temple and has been conducting the festival for the past two years. However, the fourth respondent is creating some problems for this year and therefore, the petitioner 3/7
has made a request to the respondent police seeking necessary protection.
4.The learned counsel for the fourth respondent submits that the petitioner wants to create a right over the temple by seeking permission to conduct the festival and therefore, the fourth respondent is having an objection. The learned counsel suggests that the Temple festival may be conducted by a Village Committee instead of permitting this petitioner.
5.The learned counsel appearing for the impleading respondents 5 and 6 submits that the respondents 5 and 6 have been appointed as the Village Committee and they are common to all the parties and that they will conduct the temple festival. 6.In reply to the above submissions, the learned counsel for the petitioner submits that the petitioner is not agreeing for conducting the festival by the Village Committee and that the said Committee was formed by the fourth respondent, in order to defeat his claim.

7.This Court, by its earlier order dated 02.06.2025 referred the matter to the Mediation Centre and also appointed Mrs.Porkodi Karnan, learned counsel as a mediator to find out the possibility of settlement between the parties. However, the mediator has filed a report stating that the mediation has failed. 8.The petitioner and the respondents 4 to 6 have insisted to grant permission for them to conduct the temple festival. Despite efforts, no agreement has been reached between them. For the dispute among these groups, this Court is not inclined to prevent the temple festival to be performed. The parties are at liberty to spend money for the temple festival. However, the temple festival would be headed by the Inspector of Police, Ammainaikannur Police Station, Ammainaikannur, Dindigul District, for this year and he shall ensure that the temple festival is conducted in a peaceful manner. The petitioner and the opposite parties shall resolve their dispute regarding the right to conduct the temple festival before the appropriate forum prior to the next year festival. 5/7
